Privacy Policy

Kinyava ("we," "us," or "our") is a focus and garden-building mobile application. We respect your privacy and are committed to protecting your personal information. This Privacy Policy describes what data we collect, how we use it, and your rights regarding that data.
By using Kinyava, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the app.
1. Information We Collect
Account Information
When you create an account, we collect your email address (if you choose to sign up rather than use the app anonymously) and a user identifier. You may also provide a display name if you enable social features.
Garden and Progress Data
We store your garden state (plant positions, growth stages, colour variants, and notes), water and nectar balances, focus session history (duration, category, and timestamps), goal progress, and section unlock status. This data is essential to providing the core app experience and syncing your garden across devices.
Social Data
If you enable social features, we store your friend connections, friend codes, and joint session participation data. Social features are opt-in and default to off.
Device Information
We may receive basic device information such as operating system version and device model through the native crash reporting mechanisms provided by Apple (App Store crash reports) and Google (Android vitals). This data is collected and anonymised by Apple and Google respectively, and is delivered to us in aggregate form. We do not use any additional third-party crash reporting SDKs.
Payment Information
Subscription payments are handled entirely by the Apple App Store or Google Play Store. We receive confirmation of your subscription status (e.g. active, expired) but never see or store your credit card number, billing address, or other payment details. Subscription management is handled through RevenueCat, which processes anonymised transaction data in accordance with their privacy policy.
2. Information We Do Not Collect
We do not collect your phone contacts, location data, browsing history outside the app, personal identifiers beyond email, or any data for advertising or tracking purposes. Kinyava does not use advertising SDKs or third-party analytics that track you across apps.
3. How We Use Your Information
We use the information we collect to provide and maintain the Kinyava app experience, sync your garden and progress across devices, process focus sessions and calculate rewards, manage your subscription status, diagnose and fix bugs or crashes, and improve app performance and stability. We do not use your data for advertising, profiling, or cross-service tracking.
4. How We Share Your Information
We do not sell, rent, or share your personal information with third-party advertisers. Your data may be processed by the following service providers, solely for the purpose of operating the app:
5. Data Security
We implement reasonable technical and administrative safeguards to protect your data, including encrypted connections (TLS), row-level security policies on our database, and secure authentication flows. However, no system is completely secure, and we cannot guarantee absolute security.
6. Data Retention
Your garden data, session history, and account information are retained for as long as your account is active. If you delete your account, all associated data is permanently removed within 30 days. Anonymised crash reports (provided by Apple and Google) may be retained by those platforms in accordance with their own data retention policies.
7. Your Rights and Choices
You may request access to, correction of, or deletion of your personal data at any time by contacting us at support@kinyava.com. You can delete your account directly within the app via Settings → Delete Account. You can also request deletion via our Support & Account Deletion page. You can use Kinyava anonymously without providing an email address. Social features are opt-in and can be disabled at any time.
8. Children's Privacy
Kinyava is not directed at children under the age of 13 (or 16 in certain European jurisdictions where applicable under GDPR). We do not knowingly collect personal information from children under these ages. If we learn that we have collected personal information from a child under the applicable age threshold, we will delete that information promptly. Parents or guardians with concerns may contact us at support@kinyava.com.
9. International Data Transfers
Your data may be processed in countries outside your country of residence, including where our service providers (Supabase, RevenueCat, Apple, Google) maintain their infrastructure. We ensure that any such transfers comply with applicable data protection laws.
10. California Residents (CCPA/CPRA)
If you are a California resident, you have the right to know what personal information we collect, to request deletion of your personal information, and to opt out of the sale of personal information. We do not sell personal information. To exercise your rights, contact us at support@kinyava.com.
11. EEA and UK Residents (GDPR)
The data controller for the purposes of GDPR is Kinyava, contactable at support@kinyava.com. If you are located in the European Economic Area or the United Kingdom, you have the right to access, correct, or delete your personal data, to restrict or object to data processing, to withdraw consent at any time, and to lodge a complaint with your local data protection authority. The legal basis for processing your data is the performance of our contract with you (providing the app service) and our legitimate interest in maintaining app stability. 12. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify users within the app or via an app store update note. The latest version will always be available at kinyava.com/privacy.

Terms of Service

These Terms of Service ("Terms") govern your use of the Kinyava mobile application ("the App"), operated by Kinyava ("we," "us," or "our"). By downloading, accessing, or using Kinyava, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Use of the App
Kinyava is a focus timer and virtual garden application. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You must be at least 13 years old to use Kinyava (or 16 in certain European jurisdictions). If you are under 18, you confirm that you have your parent or guardian's consent to use the App.
2. Accounts
You may use Kinyava anonymously or create an account using email, Apple Sign In, or Google Sign In. You are responsible for maintaining the security of your account credentials. If you believe your account has been compromised, contact us immediately at support@kinyava.com. We are not liable for any loss arising from unauthorised use of your account.
3. Virtual Currency and Items
Kinyava uses virtual currencies (water and nectar) and virtual items (plants, decorations) that have no real-world monetary value. Virtual currencies are earned through focus sessions within the App. They cannot be exchanged for real money, transferred to other users, or refunded. We reserve the right to modify the earning rates, pricing, and availability of virtual items at any time.
4. Subscriptions and Payments
Kinyava Pro is an optional paid subscription that provides additional features. Subscriptions are billed through the Apple App Store or Google Play Store. Payment terms, renewal, and cancellation are governed by the respective app store's policies. Subscription prices may change, but changes will not affect your current billing period. You can manage or cancel your subscription through your device's app store settings. If your subscription expires or is cancelled, Pro features will be deactivated but your existing garden, plants, and progress will be preserved.
5. User Content
You may create content within the App, such as plant notes, display names, and goal descriptions ("User Content"). You retain ownership of your User Content. By creating User Content, you grant us a limited licence to store, display, and process that content solely for the purpose of providing the App's functionality. You agree not to create User Content that is offensive, harmful, illegal, or infringes on others' rights. We reserve the right to remove User Content that violates these Terms. If you encounter inappropriate content from another user, you can report it by contacting support@kinyava.com.
6. Social Features
Kinyava includes optional social features such as friend connections and joint focus sessions. Social features are opt-in and default to off. When enabled, your display name and focus session activity may be visible to your friends. You may disable social features at any time in the App's settings. You agree to use social features respectfully and not to harass, spam, or abuse other users. You may block or report users who violate these standards.
7. Prohibited Conduct
You agree not to: reverse engineer, decompile, or disassemble the App; attempt to exploit bugs, glitches, or vulnerabilities to gain unfair advantage; use automated tools, bots, or scripts to interact with the App; impersonate another person or misrepresent your identity; use the App for any illegal or unauthorised purpose; or interfere with the App's operation or other users' enjoyment of the App.
8. Intellectual Property
All content within Kinyava, including but not limited to artwork, plant sprites, animations, character designs, sound effects, the Dew character, user interface designs, and source code, is owned by Kinyava and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our written permission.
9. Disclaimer of Warranties
Kinyava is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy or reliability of any content within the App.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of virtual items, or interruption of service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for Kinyava Pro in the 12 months preceding the claim, or £50, whichever is greater.
11. Modifications to the App and Terms
We may update, modify, or discontinue features of the App at any time. We may also update these Terms from time to time. If we make material changes, we will notify you within the App or through the app store. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms or engage in conduct that we determine to be harmful to other users or the App. You may stop using the App and delete your account at any time through Settings → Delete Account, or by contacting us via our Support & Account Deletion page. Upon termination, your licence to use the App is revoked, but sections 8, 9, 10, and 13 of these Terms will survive.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.

Support & Account Deletion

If you need help with Kinyava, have a question, or want to report a bug, please email us at support@kinyava.com. We aim to respond within 48 hours.
Deleting Your Account
You can delete your account and all associated data in two ways:
Within the app
Open Kinyava → go to Settings → scroll to the Account section → tap Delete Account. You will be asked to confirm. Once confirmed, your account and all associated data (garden, plants, focus sessions, goals, friend connections, and notes) will be permanently deleted within 30 days.
Via email
If you cannot access the app, send an email to support@kinyava.com with the subject line "Account Deletion Request" and include the email address associated with your Kinyava account or your Kinyava User ID. We will process your request and confirm deletion within 30 days.
What Gets Deleted
When you delete your account, the following data is permanently removed: your profile and account information, your entire garden (all plants, positions, and growth stages), all focus session history, all goals and progress data, all plant notes, friend connections and social data, and your water and nectar balances. This action cannot be undone.
Subscriptions
Deleting your Kinyava account does not automatically cancel an active Kinyava Pro subscription. To avoid being charged after account deletion, please cancel your subscription through your device's app store settings (Apple App Store or Google Play Store) before deleting your account.
